I am a owner in an apartment in Tambaram. There are about 70 Flats out of which 45 are occupied. It was constructed in 2016. Till date no association has been registered. A few owners are taking things into their own hands and collecting maintenance charges and doing only those works which is beneficial to them. If myself and few other owners inform them of our problems they do not respond properly and do not take required action. I would like to know what to do to get the apartment association to be formed and registered so that our problems are solved.

Introduction:

In the bustling neighborhood of Tambaram, where harmonious community living should be the hallmark of apartment complexes, an issue has surfaced. Despite the existence of 70 flats, with 45 already occupied since its construction in 2016, the absence of a registered association has led to a myriad of challenges. This article delves into the concerns raised by an apartment owner who, along with several others, is grappling with a lack of structured governance. With a few owners seemingly taking matters into their own hands, the collection of maintenance charges and selective focus on beneficial tasks has created an atmosphere of discontent. The inquiry at the heart of this article seeks guidance on the necessary steps to establish and register an apartment association, providing a framework for collective problem-solving and fostering a sense of community empowerment.

The Current Predicament:

Within this apartment complex, a subset of owners has assumed a unilateral approach, addressing only the tasks that align with their interests. This fragmented system not only perpetuates inequalities but also hampers effective communication and action when it comes to addressing the concerns raised by residents.

Unresponsive Management:

The core issue intensifies when attempts to communicate problems to this unofficial management yield unsatisfactory responses. The lack of a structured association leaves owners without a proper channel to voice grievances, seek resolutions, or ensure that the collective well-being of the community is prioritized.

Seeking Solutions:

To remedy this situation, the concerned owner, along with like-minded residents, is keen to explore the formation and registration of a legitimate apartment association. This process would not only establish a formal framework for addressing issues but also foster a sense of community involvement and cooperation.

Steps to Establish an Apartment Association:

  1. Community Consensus: Rallying support from fellow owners is the first crucial step. Creating awareness and garnering agreement on the need for a registered association lays the foundation for a unified effort.
  2. Drafting Bylaws: Collaboratively creating bylaws ensures that the association operates with transparency and fairness. This document outlines the rules, responsibilities, and decision-making processes, providing a structured framework for governance.
  3. Election of Office Bearers: Establishing leadership positions through fair elections ensures that the association is representative of the community's diverse needs. A president, secretary, treasurer, and other key roles contribute to effective management.
  4. Legal Registration: Engaging legal professionals to guide the association through the registration process is imperative. This step formalizes the entity, providing legal standing and recognition.
  5. Regular Meetings: Instituting regular meetings encourages open communication among members, fostering a collaborative atmosphere. It becomes a platform to discuss issues, propose solutions, and ensure that everyone's concerns are heard.
